If a brand store that has registered a trademark (TM) is copied, will Amazon not protect it?

We are a store with Amazon Brand Registry, but our trademark is currently still under TM status. Two months ago, we discovered that one of our products was copied by another seller. Our product is manufactured by a factory we contacted directly and is branded with our company's trademark (TM) logo on all packaging. We have not authorized any other sellers to sell our product, so it is impossible for them to be selling the exact same product as ours.

We immediately contacted the seller via email, but we have not received any response. Subsequently, we sought help from Seller Support and account managers, but no effective solution has been provided.

You'll have to do a test buy to find out if it is a counterfeit.

If the other seller got your item and brand matches up and the item is the exact same, there is no issue here, no laws are being broken.

If they are using your brand name on a copied product, you don't have any recourse right now since your trademark is only pending.

If they copied your product but using their brand name, and you don't have a patent on the product design, then there is no laws being broken.

If in Canada, You have the same rights than a fully registered trademark. You need to consult a Canadian trademark lawyer if Amazon can't fix the problem. Amazon have their own ways and rules but ultimately the Canadian Laws prevail. Many sellers are confused, including JPart2 and in your case, the advice given to you here is incorrect, the trademark infringing seller is creating confusion in the marketplace and is violating your IP. Sometimes your wording might be incorrect when you file a complaint with support and it gets rejected by Amazon, it happened to me. A good lawyer fixed it for me in less than 48 hours.... around 1300$ CAD. You need to deal directly with the infringing seller and not Amazon if you choose to hire a lawyer.
