Brand Registry Ineligible
Hello,
One of my company's brands is "eligible" for Brand Registry and I am working through completing the registration process (Case ID: 16514173981). My company's other brand has been determined "ineligible" (Case ID: 16268650881). The decision was made due to one or more of the following reasons:
a) your account was engaging in conduct that violates Brand Registry's policies, such as, but not limited to, invalid notice submissions through our notice submission channels or tampering with the catalog;
b) your application or account is related to other Amazon accounts or brands that have violated Amazon or Brand Registry's policies;
c) you are associated with one or more selling accounts as a primary owner and all of them have failed seller verification;
d) inability to provide sufficient evidence of branding on products/packaging;
e) you have a selling account that is de-activated, or f) your trademark application appears to be filed by a filing firm that may be violating US federal regulations and USPTO rules.
I went through each potential reason and attempted to take any corrective action when appropriate and possible. In an abundance of caution, I finally decided to re-register my brand with USPTO. The rejection emails I keep receiving state that I may resubmit a new enrollment request after re-registering my brand and I also want to correct the brand name because the capitalization is incorrect. When I attempt to begin a new enrollment and type the brand name under "What is your brand name?", I receive an error message in red under the box that states "Application for brand [my company's brand name] is currently under review." However, the only application I had submitted for that brand has been rejected and there are no pending appeals.
Has anyone encountered this or have any suggestions on how to address this issue?

Sounds like you have past problems on the Amazon site, and they will not go away.
Registering a brand is really simple, if the brand already exists in the real world. I own 5 brands and sell 2 on the Amazon site. None have any USTPO registration, but each had its own B&M store for the past 30 years. All the branded products meet all requirements for USA sale. They really exist in the real world.
If you are trying to start a brand on the USA site, it is a long uphill proses., and at this time of the year (holiday season), Amazon cuts way back in approving both new brands and new sellers.

First, because of the current "ineligible," status for the brand, you cannot create a new application. The only path forward to enrolling this brand in Amazon Brand Registry is to successfully appeal the decision. You will find this in your Brand Applications Dashboard on the Brand Registry site under the "Actions," column in line with the ineligible status and case ID you shared here.
Unfortunately, I cannot provide additional detail beyond the 6 potential reasons provided in your case. I know you mentioned that you went through each potential reason so whatever you found or change you made, you would provide that information in the current appeal case (16268650881). The appeals team will review and render a decision.
