How do you get your private label product gated "apply to sell" vs "sell this product"

I have been selling on Amazon for 4 years and recently launched a new product line. Great news is my product is doing very well, winning the Best Seller Badge after only a few months. Unfortunately, that came along with several Chinese hijackers as usual. Our Trademark is pending and will be for the next 1 yr+, so Transparency is off the table.

The hijackers are selling similar products, but my product has upgraded components, branded labeling, and a comprehensive quality check. We have had several hijackers come on our listing, resulting in us having to tank our price multiple times to keep the buy box. We have also had negative reviews from their products (I can tell by menu>brands>reviews and it tells me when a review was from another seller. This has negatively affected our sales.

My question is how to get my brand gated. If I go to the "Add a Product Tool" on Seller Central and search my product, almost all of my competitors' listings say "apply to sell" while mine says "sell this product" and it is as simple as adding offer details to sell on my listing, while you have to submit invoices for my competitors' brands. In the past, I have tried to escalate this issue to Amazon with proof of counterfeit products. My photos clearly showed all the differences, but they refused my infringement reports or requests to have my brand gated.

Amazon's policies allow any seller to list items for sale on an ASIN so long as the intellectual property accurately represents the item being sold and has not been illegally reproduced. This includes intellectual property for which you are the rights owner.

In addition, Amazon respects a manufacturer's right to enter into exclusive distribution agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Amazon to assist in enforcement activities.

If you do believe these other sellers are selling inaccurate products related to the listing, I recommend completing test buys to obtain proof of these sellers committing violations.
