no but it makes things a lot harder.
You won’t be able to do brand registry without a trademark.
You can I believe still create listings with a brand if you don't have brand registry - but you lose out on a lot of the bells and whistles like Brand store, A+ Content and more.
If you can afford the outlay - trademarking can be beneficial.
