Definition of insanity

Bullet points to explain the situation rather than a dissertation:

1) Selling on Amazon for 12 years

2) Authorized laser manufacturer registered with the FDA for Class IIIa, less than 5mW laser products.

3) All ASINs are labeled in 2 different locations with the warning label Amazon requires as well as additional warning labels that the FDA requires but not Amazon itself.

We (and hundreds of other laser vendors) had our listings removed on an Amazon seller purge because Amazon deemed them as "This product has been identified as a laser that violates Amazon policy. Amazon policy generally requires that laser products be Class I, II, or IIIa, and have a power output of 5mW or less."

We provide them with official FDA documentation showing our FDA Ascension number and number of lasers manufactured and tested in our facility in Gainesville, Florida. They respond with:

"This product has been identified as a laser that violates Amazon policy. Amazon policy generally requires that laser products be Class I, II, or IIIa, and have a power output of 5mW or less."

We ask them if they require any further documentation on our laser output. They respond:

"This product has been identified as a laser that violates Amazon policy. Amazon policy generally requires that laser products be Class I, II, or IIIa, and have a power output of 5mW or less."  

We ask if there is an issue with the text on our ASINs, they respond with:

"This product has been identified as a laser that violates Amazon policy. Amazon policy generally requires that laser products be Class I, II, or IIIa, and have a power output of 5mW or less."

We then add text concerning laser distance and are grasping at straws BECAUSE AMAZON HAS NO WRITTEN POLICY on what should be added nor is there any advice given, for anything, Like literally, there is nothing to read or reference to find a solution.

I think I figured out their issue and it leaves me almost speechless. Somebody in their "Compliance Department" has dropped the ball and doesn't even know what the correct FDA classifications actually are. You'd think they would have people in place that actually read the laws they're trying to uphold. There are 3 legal classes Class I (also called Class 1 or Class 1M), Class II (also called Class IIa, 2, 2M), Class IIIa (also called Class 3R). It looks like someone who doesn't know anything about lasers made the decision and doesn't realize that the FDA approves use of ALL of those names for the 3 classes. Unbelievable.

When it comes to restricted products, they can refer to both the product and the listing. As you've described, it sounds like the product meet the necessary requirements. Have you reviewed the listing for any mention or reference to a prohibited laser or power? Our laser policy help page does offer a few examples of prohibited products you can review for:

  • This page describes Amazon’s policies regarding the sale of products that incorporate a laser in the product’s design. Laser products in hazard classes IIIB and IV are not authorized for sale by the FDA in the United Sates without a variance, which Amazon does not currently support. Since we do have limited visibility into your account, can you provide us with some example ASIN and or cases for us to look further into this?

I had reached out for more clarification on the overall situation and have been advised that even the mention of 3R would be a violation of our policy. If present, it would need to be removed to be compliant.

Here are 2 ASINs that are indicative of the same issue for about 150 of our ASINs: B01LYQFS8M and B00SLJD9PA.

I have looked over both ASIN and found the mention of 3R in the listing a few times. Attribute: Class 3R Laser Product. As noted by the clarification I had received, the mention of 3R will need to be removed from the ASIN to be compliant with this policy. I also noticed on both ASIN you reference the same attribute as: Class IIIa Laser Product. If the product is an IIIA laser product and not a 3R laser, it would be advised to update the listings.
