Seller Name including Trademarked Brand Name

If I have a brand deal with a well known brand, say for example “Adidas” would it break the trademark rule if I changed my Seller name to something like Adidas Distribution Warehouse/Adidas Seller. I’ve recently scored an amazing brand deal. With being new to FBA, this brand deal could earn me an absolute fortune and I’d like to dedicate some time just to that particular brand. Amazon are currently on the listing as well however I’m completely confident they can’t get it for a better price than me. It’s just something I thought could help me stand out.

I am a legitimate distributor for this brand.

Yes I would imagine so, Personally I would assume they would assume that you were trying to masquerade as Adidas and use their name to gain trust from customers.

Unauthorised and improper business names:

Your business name (identifying your business entity on Amazon) must be a name that: accurately identifies you; is not misleading; and that you have the right to use (that is, the name cannot include the trademark of, or otherwise infringe on, any trademark or other intellectual property right of any person). Furthermore, you can’t use a business name that contains an email suffix such as .com, .net, .biz etc.

I presume if you are selling a well known brand that you have checked that the brand can be sold on Amazon, have permission from the brand owner to sell it (and a LoA to prove it to Amazon), and proper invoices from an authorised distributor (ie not a random wholesaler, and definitely not a liquidation place) to counteract any counterfeit claims that may come through.

You would be very wise not to make the assumption that Amazon get a worse price than you.
Also dont assume Amazon will give you the buy box if you undercut them,its highly likely Amazon will beat whatever price you set.
Be very careful with this.

Without going into yes and no’s about stuff, one word of warning…

NEVER do anything like this with ADIDAS, they have a trademark team that is on the constant hunt for even the slightest infringement, been there, experienced it.

Bear in mind, that even if you can get it for a better price than Amazon. Amazon do not have to pay Amazon commision, thus their cost is lower before you even start. Also, the cost of delivery for them, will be less than what they charge you, as they will get it at cost. They also have a habit of crashing the price, just to keep and maintain the buy box.
So the above, plus the other reasons given previously, makes this a very risky proposition. Unless you can guarantee that the supplier is 100% behind you and will no longer supply Amazon directly.

Be careful with prices. I had a product with a big brand name and I was associated with the sole distributor of the brand. Amazon bought from them too and I knew how much they paid for the item so I know they were selling the product for way less that they actually bought it for. The distributor stopped selling to amazon because of this but it goes to show amazon will do anything to drive prices down.

I would suggest you take legal advice on this, but from a very brief thought - the only way that would work is if Adidas have granted you a license to trade under their trademark. Having rights to sell a product is very very different from trading as someone. If your business uses someone’s registered trademark in your name then you are - to all intents and purposes - trading as that company.

Probably the easiest way to answer the question would be - do you see a single example - anywhere - of some other business doing that while being wholly independent? Can you imagine setting up a store on the high street and calling yourselves ‘Sony Distribution’ and Sony not suing your pants off?
