Competitor Trying to Wipe Me Off Amazon
Hello Amazon Seller Community and Moderators (@CR_Amazon, @Cade_Amazon, @Stevie_Amazon or anybody, please!)
I’m posting this because I recently received a trademark complaint from a competitor, claiming that my product infringes on their intellectual property rights. However, my product is entirely unique in branding, design, and content, with no references or imitations of the complainant's brand. This complaint appears to be an attempt to gain an unfair competitive advantage by removing my product without valid grounds.
Here’s a summary of the key points and evidence I’ve submitted to Amazon Seller Support, all of which clearly demonstrate the originality of my product:
Copyright Registration: My product’s unique text and artwork are protected by U.S. copyright registration. This provides legal assurance that my content is original and independent, with no overlap or infringement on any other brand’s intellectual property.
Pending Trademark Application with USPTO: My brand name has been filed with the USPTO and is currently pending approval. This reflects my commitment to building a legitimate and distinct brand identity, separate from any other similar products in the marketplace.
Independent Branding and Design: My listing, title, keywords, and all content are specific to my brand. I do not reference or attempt to imitate the complainant’s brand anywhere in my product details. The brand names themselves are distinct, with different primary terms, making confusion unlikely.
Invoices from Manufacturer: I have submitted invoices demonstrating a legitimate supply chain, confirming that my products are independently manufactured and sourced. This supports the originality of my product and further disproves any claim of imitation or infringement.
Generic Product Category: Both products fall under a general category of items, which is not exclusive to any single brand. The complaint seems to be an attempt to claim rights over a generic product type rather than a specific brand element.
Despite presenting all this documentation, my appeal was rejected, leaving my listing at risk of removal. The complaint IDs associated with this cases are 16545591821 and 16545354841 (same reasoning for the compliant), and the Case ID with Amazon Seller Support is 16580852251.
My product has a rightful place on Amazon, and it’s crucial for sellers to be protected from unfounded claims that jeopardize fair competition.
Thank you for your time and attention to this matter. I appreciate any assistance or guidance to ensure a fair resolution.
Best regards, Max
