Intellectual Property Infringement
Appeal Letter:
Dear Amazon,
My account was suspended due to an intellectual property infringement. Please find attached below the actions I have taken to identify and resolve the issue.
Root Causes:
• We had mistakenly listened the above ASIN B07R69X89K ¸B0B93WP4T8 , B09WVX5LT1 not knowing it was under a listing someone had created that was not authentic.
• We have been reported for copyright infringement from the rights owner listed above. We understand that sellers on Amazon.com are not allowed to create listings or details pages that infringe copyright.
• We have created removal orders for all our listings pertaining to that ASIN. We have closed our listing and will not reopen them until we confirm that these products are authentic.
• We have not received any order and customer complaints or returns for these products. If we do receive a customer complaint, we will immediately return their money and let them keep the product.
• As a precaution, we have deleted our entire inventory listing as to make sure we do not do this mistake again.
Preventive Measures:
• Will be reading up to date on Amazon’s Policies and Agreements on a weekly basis to ensure I am fully up to date and comply fully when working on the Amazon marketplace.
• Before we purchase anything, the product is now researched to make sure that we are not infringing any intellectual property rights, and the products are authentic. We will not purchase the items until we can guarantee it is authentic.
• We will only be purchasing products from sources that are Authentic Distributors /wholesalers of that product, and will no longer be purchasing from retailers.
• We will only sell products that are authorized to sell and with the permission from the right owner.
• We believe this had happened simply because of the listing. We listed this item did not have permission from the right owner. We had mistakenly listed this item now knowing the actual listing was not authentic.
• Our inventory was sourced via retailers, and we did not have authorization from the brand right holders to purchase their products to resell on Amazon.com. Therefore, the items could not be verified as Authentic goods from the brand rights holder.
We greatly appreciate your consideration into this and in reinstating our selling ability.
