Wrong infringement warning
Hello to all,
I just received twice an infringement warning saying that my product has violated the design patent of someone else. I did check on UK IPO website with the provided patent number and it is very different design from my product. I have appealed, and Amazon has admitted it was an error ( quote: “we sometimes err on side of caution.”) and reinstated my listing, twice. My listing is now active, but when I go to my Account Health, the warning is still hanging there.
I also received 2 emails from Amazon selling team, saying that they are investigating this issue.
I contacted seller support and the agent created a report stating this issue. He said if the warning doesn’t disappear wthin 48 hours after the reinstatement of my listing, it is gonna stay there for 180 days!
I have appealed the third time, showing the patented design product side by side with my product, to clearly let Amazon see that these are 2 very different designs, and also uploaded the screenshot of Amazon’s “error” emails. But they kept saying that my listing is suspended until I provide a letter of authorization from the claimant patent owner. Meanwhile, my listing is still active.
I am afraid that this mistaken warning will affect my account health.
I am contacting now my design patent owner to get a letter of authorization. The tricky part is that this design patent is only registered in China, but not in UK or EU (the patent owner is also the manufacturer, they develop their own products and manufacture them, I am sourcing from them and put my own label on it. My brand is registered with UK IPO and I have brand registry)
While I am going through the appeal procedure, can anyone who has been through the similar situation give me some advices? I am ao afraid that Amazon gonna say that the patent need to be registered in Uk to make the LOA valid and suspend my listing for real!
