Why would the standard be; listings are ungated and sellers sell on them. If the brand owner wants to they can file a IP complaint. Why wouldn’t it be, if the brand owner complains, the listing becomes gated to the seller? No health penalty, just a penalty of not being left with product they can’t sell? Help me understand why it isn’t just this?

Because without proper documentation to sell one product, your whole store is considered "inauthentic", and the inquiry begins.

So you say that you want sellers to be able to sell unauthorized and/or counterfeit goods up until they get caught, then be able to keep selling with no penalty, right? Do I understand your question properly?
I'll note that the current system is not very good, allowing sellers to fall into traps. But doing away with penalties is not the answer.
