VAT Refund to sellers

Morning All
Im a UK Seller, Has anyone successfully reclaimed VAT charged whilst VAT exempt in the UK. Once VAT registered AMAZON stops charging you VAT on your sales and obviously you then pay HMRC yourself.
My understanding is prior to being VAT registered and having VAT exempt status confirmed on amazon they should not have been charging VAT on your sales (PPC yes but that’s different) because they are not based in the UK.
I’m no tax expert nut this is how my accountant explained it to me.
any suggestions ?

yes others have
you need to send amazon your previous years full tax returns as i understand it
don’t forget though that the refund (if successful) will need to be added and accounted for in your tax return

  • Certificate of Incorporation.

  • Tax Return for 2020 - 2021 and 2021 - 2022.

Haven’t done 21 -22 yet so chasing my accountant as we speak, will update post in due course

can i kindly ask you who at exactly Amazon/agent/team did you contact to make the reclaimed of VAT.

we are ltd. way before UK VAT, and traded on Amazon for about 5 years at around £1200 a month then.

so possibly we have some form of reclaim. it`s worth a go. i realise we would have to account any refund as income to the business etc.

submit request, first reply i got back was something about no giving refunds, then submitted it again and they asked for more details etc

When I registered I was sent a refund of the vat on fees for a period before I registered, can’t remember the exact period but that happened automatically by amazon

We successfully reclaimed a VAT refund. I believe its because Amazon are not registered in UK. They would only go back four years.

Yes I did it some years ago but it was a complete nightmare.

Amazon constantly dragged their feet and closed cases multiple times. I even wrote to the MD but that didn’t help.

After over a year of trying they then changed their polices to say that they would no longer pay VAT claims, so they told me they wouldn’t pay up. I pointed out that when I started my claim that was not their policy and it was not my fault they had dragged their feet and taken so long. This wasn’t the first time either that they had changed their policy half way through a long drawn out case and then tried to retrospectively apply the new policy.

After well over a year of fighting, to my surprise they eventually paid up.

However, like I said, they changed their policy to say they would no longer pay VAT claims, so if anyone has done this recently I’d be very interested to hear.

I have never been VAT registered (At least not while selling on Amazon) and was not aware of this. I first sold here as a sole trader and then later (As now) as a Ltd company. Would I need to claim separately for the periods as a) Sole Trader and b) Ltd Co. or would Amazon lump them all together or decline the earlier period?

Following this thread yesterday I made a claim last night.

I am not entitled to a refund but the very knowledgeable email explaining why said it was because I was out of the 4 years Statue of Limitations. I have been VAT registered for the 4 years so No VAT paid in this time.

So officially you can claim back the VAT paid for the last 4 years.

I can honestly say it was the best response email I have ever had from SS, explained in detail, including my last 10 years figures. Why can’t all SS put this much effort into their work.
