Got locked out of my own brand

Hello fellow Sellers! 

I'm enquiring today if anybody has been in this situation and maybe knows what went wrong and how to fix it. 

On March 8th, I've applied for Catalog Authorization for my new, just dreamed-up non-trademarked brand in the OFFICE category. And I was approved.On March 18th, I've applied for GTIN Exemption for the brand and also got approved.So far so good.

Later in the day on March 18th, I went to create a listing and got an error message saying that I'd have to apply to list products of my brand with images of the product and invoices from the distributor and all as usual.

I've created a ticket (14963100251) and had a chat with very helpful and dedicated resolution specialist, who tried to figure out what was going on, what went wrong, and how to fix it. Unfortunately, after numerous consultations with several teams and several escalations, I am still not allowed to list products under my brand.

The explanation I was given is that my application to list products under my brand was rejected because ".. ASINs for the requested brand “MYNEWBRAND” already exists on catalog"

When I asked what ASINs and how is that possible given that the brand was created by me 10 days ago, I did not receive an answer.I've asked what did I do wrong or what went wrong and I did not receive an answer.

The advice I was given was to apply through the brand registry.

Applying through the brand registry requires a trademark, which I do not have yet. And it is not that I am against applying for the trademark, but I do not have any assurance that the same situation would not repeat again WITH the trademark. I know, it is compliant with TOS to have a brand that is not trademarked and does not have UPCs. There is an application process to achieve that and I went through the process following the rules. Somehow, at some point, I got locked out of my own brand and I do not know why and how that happened. 

At this point, I can accept that this brand did not work out. But to move on and apply again, I need to understand what was done wrong, so I do not repeat the same mistake again. I sincerely hope that someone from the Seller Support Team can help me to figure it out.

I understand your situation with your product that you can't list due to issues with the error 5461. Upon checking your case 14963100251 with Seller Support I can see that our Seller Support team advised you to follow the process with Brand Registry to be able to list this product, so you can rest assure that if you follow those steps you will be able to list the product without any issues, however, if by any chance that doesn't work, you can let us know here in the Forums so we can look further and help you.

If right now you don't have an active registered trademark in each country where you would like to enroll, you can still apply to Brand Registry if you have a pending trademark application that is filed through Amazon IP Accelerator or a trademark that is pending registration in a subset of accepted trademark offices.
