Sending a free mp3 download?

We sell home produced speciality CDs on Amazon FBA all which are available on our website as mp3 downloads (which we can't sell on Amazon) However, as fewer people are buying CDs these days, we though we would offer the free download of the item when the customer received the CD and emails us with their order number. The problem is, once the customer gets the download, there is nothing to stop them sending the CD back. Firstly, would this be allowed on Amazon and secondly, would I just have to take the hit from unscrupulous buyers.

I don't think it would be allowed as we are not allowed to give out URLs and/or direct buyers to our own websites

In short - it's possibly against amazon policy - it depends on if amazon deem an mp3 'digitally downloadable software' - technically an mp3 isn't software.

Digital Download

In order to protect customers, sellers and rights owners from digital piracy, sellers are not allowed to sell digitally downloadable software by any means whatsoever, including by way of activation codes, registration links, licence keys, serial numbers or any other credentials related to software products. For the avoidance of doubt, this prohibition includes, but is not limited to, providing access/activation information by email, Amazon messaging system, third-party sites, any electronic channels, or by way of printed or physical form.

That being said - even if you could - you would still need to message the customer via amazon messaging - but that would block any URLs or the URLs might get picked up on as trying to take the sale outside of amazon.

The correct way to do this would be to do what you often get with vinyl records. So a unique download code with each order, printed and included in with the product. That would still leave you open to sellers buying the CD, downloading the product and returning the CD.

Unlikely, I would think. It could result in a violation if you tried to do it via Amazon messaging.

You obviously can't sell mp3s directly as a 3rd party seller but I assume it must possible to sell them via Amazon itself. I don't know exactly how you would go about getting them 'published' in that way though I daresay someone here might know.
