Account at Risk for selling a Cadbury's bundle
I am pretty frustrated because I brought this product from Tesco and it’s a Cadbury bundle. I tried to explain that on the phone to Amazon seller support but they said this is in line with policy and tried to create a case log and the same thing happened again. I only sent in £6 worth of inventory now my account is at risk.
I sent in my Tesco receipt but it hasn’t been accepted. Tesco wouldn’t give me an actual invoice.
I emailed the right’s owner and followed up but they haven’t responded.
Worried that my account is going to get suspended now. Not sure what to do?

You have listed on a “fake” listing that is using a brand to overwrite someone else’s IP and get around gating / keep a unique listing. You will get nowhere with Amazon on this one to be honest - you don’t have anything that matches the wrong brand on the listing. Even if the listing was correct, Amazon are unlikely to accept a receipt from any retailer as proof of authenticity.
If RA / OA is your current business model then i would suggest minimising the financial risk by moving to a more traditional business model.

Yes, having a look at the listing, the actual brand that is kicking everyone off is very much infringing Cadburys IP, but that would be on Cadbury to do something about it - and doing a quick search for Cadbury on amazon, suggests they aren’t too bothered.
But as Demel has said - you contact seller support - they will fully believe that the brand on that listing is STT Sweets - and that is what you should have on an invoice. You won’t have that, they will win.

What do you actually have in your account heath? I assume that this has hit “received intellectual property complaints” and this will hit your account heath score. If that goes below 200, there may be issues, though you might be asked to write a plan of action?
Unfortunately never had to go through that, so can’t advise in detail.

As per the image shared, I see that you have received intellectual property complaint with the infringement type counterfeit.
Amazon does not allow listings that violate the intellectual property rights of brands or other rights owners.
While listing a product on Amazon you should make sure that the you are procure the inventory from a verified supplier and have valid invoices.
To reactivate your listing you need to provide an invoice, letter of authorization or a licensing agreement from the rights owner.
In this case, a normal purchase receipt will not be considered as invoice, Tesco being a brand and if you have actually sourced directly from the brand then you can submit a letter of authorization.
You can always reach out to the rights owner and if they are unresponsive then you can submit an appeal explaining why did you list the product and also provide preventive measures on how you will make sure that you will not receive any intellectual property complaints in the future.

If you go to appeal and then select the option to acknowledge that you were in the wrong, a page should come up that lets you tick boxes to confirm that you understand what you’ve done wrong and have systems in place to prevent it happening again etc.
Filling and submitting that might remove the infraction from your account. Make sure you have actually done what you’re ticking to say you’ve done though, and absolutely move away from Retail Arbitrage, as you will never be able to prove valid supply chain to sell as new with that method.

Always check the Brand on the listing if wrong avoid as you’re playing with fire. I had this happen to me on Cadburys Advent Calendars I did have a proper invoice. But as the person on the listing put their own brand despite being Cadburys the violation won’t be removed.
It says at risk because you are a new seller. 1 violation you should be fine just make no mistakes and build up your selling history and feedback.
Probably more but mistakes you need to be in particular careful to aboud.
- FBM ensure you send on time and VTR
- Avoid listings where the “Brand” does not match the image and/or the description
- Ensure you have invoices for every product you sell
- Ensure all your products are identical to the one in the listing photos and description
- Ensure Business Customers get their invoices within the deadline
- Respond to all Customer messages within 24 hours
