Small Claims court or Managing Director

Hi,

I recently had a customer contact me to return an item worth £100. She opened an A to Z saying the item was not as she thought. I offered her a refund and gave return details etc and amazon granted her a full refund without returning the item. I appealed and lost.
Does anyone have any advice where to go from here. Is it worth contacting the managing director or smalls claims court? if so, has anyone had success in a small claims court in these situations?

Lots have success with Small Claims,send the buyer a Letter Before Action.

According to the Amazon Business Solutions Agreement, you have 30 days to appeal each A-Z claim decision. So if the initial appeal attempt through the A-Z claim form failed, e-mail the Managing Director at managingdirector@amazon.co.uk . This is the highest department which normally reverses claims to change them into Amazon Funded.

If you are considering a legal action, then you should know that taking a recourse against your Amazon customers once Amazon refunds them through the A-Z guarantee is prohibited.

Of course, the buyer would have to actually contact Amazon to let them know about it and prove that it happened for it to affect your account in any way.

Not sure I have seen in this thread, what reason Amazon gave for telling the buyer they did not have to return the item (s) …

I have had a number of these but mine are adding up to £600+. Im not sure what to do or who is then liable. If Amazon give the refund without the sellers permission is that legal? BUT if the customer has the item and a full refund then is the customer liable as they ha
ve goods which are not paid for?

To be honest Im sick of it and furthermore it seems the A2Z staff are inexperienced and simply ticking boxes with no evaluation of the actual problem. Most of the time they dont even read all the text and correspondence regarding the case.

Hi,

I feeling your pain, amazon for some reason now always side with the buyer no matter the reason.
You then have to appeal, I have found this to be a waste of time 9 times out of 10, no matter the reason. For example a buyer buys an item I then send it tracked, delivery is confirmed via the tracking, buyer opens an AZ claiming the item did not arrive, amazon then side with the buyer. I then appeal repeating the tracking details they maintain their decision.
Ebay don’t let buyers get away with this nor do any other out lets.
FYI I emailed the managing director with all my concerns about 2 months ago had zero reply, even resent the email again zero replies.
Amazon are committing a crime in my eyes, we pay 1000s if not 10,000s of pounds every month on seller fees, they should be protecting the buyers as well as the sellers. Sadly its all about profit to them they do not care about it sellers if you ask me.

So Amazon considers its self above the Law again does it ?
They could then taken to court for that .
Judges are very stiff on retaliatory action.
