ASIN Brand hijacked- URGENT!

Hi Jim,

I found through other seller posts, wanted to reach out as my ASIN is hijacked since March 6, reported abuse, case is filed but the hijacker sits on my listing starting 8AM every morning up until 9PM EST. Steals buy box, sales. They have already got counterfeit in their seller feedback, not sure why they are not trashed yet.

ASIN: B0DJPS8CT4

CaseID: 17398292161, required screenshots, case history is presented already to internal team & is being reviewed, I just wanted to know the timeline for the same & what is exactly happening since its a week, I lost rank/sales and completely anxious.

I have also reported violation on Brand Registry, Case ID: 17403172411

Please help me!! I am the only brand registered owner of OHaai, need protection.

I always advise reviewing the Intellectual Property for Rights Owners help page. I suggest paying specific attention to the "Types of notices not accepted on Amazon," section. Specifically the Exclusive Distribution bullet point. Report a violation submissions should include Specific identification of the IP you believe is infringed.

Hi @Dougal_Amazon this is the response I received- not sure what is happening, am I doing something incorrect, pls guide me..

I have reported abuse for a test buy, its been a week, not sure where the case is, I have lost sales, ranking and I am thinking to close the listing if I see no help from Amazon, the fake seller everyday is receiving seller feedback stating its counterfeit but they still hijack multiple listings including mine and sell counterfeit. seeking desperate help and like this to be escalated.

I see a few areas of opportunity on this. I will list them below, but please let me know if you have any questions on any particular one:

  1. You escalated Complaint ID: 17416647701 with the Infringement type: Trademark: Product or packaging, but the additional detail you provided was discussing how the product you received in your test buy was counterfeit. _ this is why you are getting the response that you pasted here. These are separate reporting options in the Report a Violation workflow for reporting TM infringement,
  2. It is not 100% clear to me which images are from your test buy and which are form your packaging. I recommend not including any of the images of how it is "supposed to" look. If all you received was a cellophane wrapped product, only provide that in your image.
  3. You are using the term counterfeit, but the trademark you have linked to this brand in Brand registry is not valid to report counterfeit. Your TM has to be registered to report counterfeit and yours is still pending
  4. There is no evidence provided or images that show how the product or packaging is infringing on your TM.

What you can do:

  1. Provide information of the shows how the product (or packaging) you received via that test buy is infringing on your TM and escalate that from complaint ID 17416647701
  2. Report Abuse of Amazon Policies from your Account Health Dashboard because "The product received is different than the product on the detail page (different version, model or product)"

Hi @Dougal_Amazon another hijacker has attacked my listing today along with chuwudianzi. I have reported it via brand registry under Report a marketplace policy violation- other policy violations referring to anti- counterfeiting policy.

Case ID for the above: 17495472891 ( new guy, test buy not done, but clear hijacker)- bianjieshangwustore ( seller name)

Also my previous case: 17478761701 ( test buy done)

I am really frustrated with these hijackers taking over the listings. Please HELP!!!!!!!!!!!!!!!!!!!!!!! I need Amazon to remove these sellers immediately. Request your kind attention & urgency to this matter.

You can see both of these on my listings right now when you search from buyer side amazon.com feeding my ASIN. Need high priority support to eliminate these sellers whom I have never authorized. I am the only owner of the brand OHaai

When you submit an Intellectual Property Violation via the report a violation tool in Amazon Brand Registry, you receive a complaint ID and are able to review it in your Submission History, but the latest complaint I see from you is 3/14 that is still currently under review. Also, marketplace violations are not options via the report a violation tool so I am guessing you reported this via the Report Abuse link on your Account Health Dashboard in Seller Central? Since it has only been a few hours, the review of your submission has not been completed so I have to wait until the investigation is completed before I can comment.

Was this reported via the Report Abuse link? Also, had you received any correspondence? I ask because there is not much info I can see on the case, but that may be because it is still being investigated.

From a more general perspective, you would need the physical product in hand (test buy completed) in order to provide accurate detail to the counterfeit claim since you cannot report just based on Exclusive Distribution.

Once these investigations are resolved I will be able to see what you submitted and should be able to provide more specific guidance (if they are not accepted).

Hi @Dougal_Amazon the old hijacker chuwudianzi now left and another one "bianjieshangwustore" has taken over, This violates Amazon’s Anti-Counterfeiting Policy (https://sellercentral.amazon.com/gp/help/external/G201361070). No test buy yet—please remove them now. Its heights of frustration... I have reported abuse this morning, will like this to be investigated asap and pull them out. I totally lost my sales the entire month!

Offers will not be removed without an investigation. These instances your are describing here are sellers listing offers on an ASIN. Please review the Intellectual Property for Rights Owners help page. Specifically, the section "Types of notices not accepted on Amazon," and the 4th bullet point where Exclusive Distribution is in bold. For ease, I pasted it below:

  • Exclusive Distribution (except in China, France, and the United Arab Emirates) – Amazon does not enforce exclusive distribution rights except within the countries that have laws specifically referring to selective or exclusive distribution.

Since you cannot report an Intellectual Property violation based on a seller's offer alone, you will need to show something that proves what is being sold is factually counterfeit.

My previous case complaint#: 17478761701 through seller central report abuse- test buy done and is clear counterfeit- Seller name: chuwudianzi and US marketplace

current case complaint#: 17507831041 submitted via seller central. completed test buy; provided order id. Seller name: bianjieshangwustore

These two unauthorized sellers engaged in pricing war this morning for Buy Box and lowered the price to the cheapest point of $3.90-$4.10, totally pathetic. Not only they are violating Amazon's system but brutally killing the seller's life.

The whole hijacker thing started since March 6 and I am not sure up until when these guys are gonna loot!!!

Looking for support here! I spoke to Account Health & seller support, nobody knows what exactly is happening & which stage is the investigation in.. please do check and let me know, it will be super helpful

Seller "chuwudianzi" permanently sits on my listing since 29th March 10 AM EST up until now completely ruining my business, I would need an immediate high priority action on this since I have submitted test buy on this seller and proves its a clear counterfeit and the patches are materially different and not as described on the product listing.

They are counterfeit and have got the same on their seller feedback several times, please kick them out immediately within today. I can't believe Amazon is still investigating my case, its a clear violation to the system.

Do you have an image for complaint ID 17507831041 similar to the one in complaint ID 17478761701?

I ask because in the image, you have a picture of the FNSKU which is an Amazon barcode label and can be used in conjunction with the order ID for an additional check in the investigation.

At this time I cannot escalate these complaints, the relevant team needs to complete their investigation.

Honestly, I had not considered that and YES you can absolutely create a virtual bundle. Since virtual bundles are confined to Brand Representatives benefits ONLY, you would be the only one that can create and list them.

EXCELLENT outside the box thinking!!

Since it was your idea, I am sure you already know how to create them, but for any other sellers following this thread, here is the Virtual product bundles help page that has eligibility criteria and the step by step process.

I have reported abuse for a test buy, its been a week, not sure where the case is, I have lost sales, ranking and I am thinking to close the listing if I see no help from Amazon, the fake seller everyday is receiving seller feedback stating its counterfeit but they still hijack multiple listings including mine and sell counterfeit. seeking desperate help and like this to be escalated.

When you submit an Intellectual Property Violation via the report a violation tool in Amazon Brand Registry, you receive a complaint ID and are able to review it in your Submission History, but the latest complaint I see from you is 3/14 that is still currently under review. Also, marketplace violations are not options via the report a violation tool so I am guessing you reported this via the Report Abuse link on your Account Health Dashboard in Seller Central? Since it has only been a few hours, the review of your submission has not been completed so I have to wait until the investigation is completed before I can comment.

Was this reported via the Report Abuse link? Also, had you received any correspondence? I ask because there is not much info I can see on the case, but that may be because it is still being investigated.

From a more general perspective, you would need the physical product in hand (test buy completed) in order to provide accurate detail to the counterfeit claim since you cannot report just based on Exclusive Distribution.

Once these investigations are resolved I will be able to see what you submitted and should be able to provide more specific guidance (if they are not accepted).

Offers will not be removed without an investigation. These instances your are describing here are sellers listing offers on an ASIN. Please review the Intellectual Property for Rights Owners help page. Specifically, the section "Types of notices not accepted on Amazon," and the 4th bullet point where Exclusive Distribution is in bold. For ease, I pasted it below:

  • Exclusive Distribution (except in China, France, and the United Arab Emirates) – Amazon does not enforce exclusive distribution rights except within the countries that have laws specifically referring to selective or exclusive distribution.

Since you cannot report an Intellectual Property violation based on a seller's offer alone, you will need to show something that proves what is being sold is factually counterfeit.

These two unauthorized sellers engaged in pricing war this morning for Buy Box and lowered the price to the cheapest point of $3.90-$4.10, totally pathetic. Not only they are violating Amazon's system but brutally killing the seller's life.

The whole hijacker thing started since March 6 and I am not sure up until when these guys are gonna loot!!!

Looking for support here! I spoke to Account Health & seller support, nobody knows what exactly is happening & which stage is the investigation in.. please do check and let me know, it will be super helpful
